1. Genaral
The following general terms and conditions (“GTCs”) apply to all orders, sales and deliveries on products that are offered in our online-shop on www.ruthofer.com owned and operated by RUTHOFER, Westbahnstraße 27-29/3/56, 1070 Vienna (AT) (“RUTHOFER / We / Us / Our”). We strongly recommend that you read them carefully before submitting any order on our website.
1.1 By ordering products from Our onlineshop, you indicate that you consent and forthwith comply with the terms and conditions, privacy policy, cookie policy, shipping policy and return policy. Also you must be at least age 18 or older and competent to enter into legally binding contracts. We reserve the right to cancel your order if we have reason to believe that you do not fulfill any of the above mentioned conditons.
1.2 The GTCs apply to all those who fall under section 1 Consumer Protection Act, Konsumentenschutzgesetz, KSchG.
1.3 We reserve the right to change our policies in the future. For any potential future orders you will also need to agree to potential future versions of our terms and conditions. Future changes in our terms and conditions will have no inpact on already concludet contracts.
1.4 Genaral terms and condition of you (the customer) do not apply even if we do not explicitly object to them.

2.1 The language of the contract is English.
3. Offer and conclution of contract
3.1 The representation of Our products in the www.ruthofer.com shop represents an invitation to place an order. Most of Our products are handmade and it is possible that products may deviate from how they are represented in Our online shop.
3.2 Orders that are palced by you using the “Buy now” button are binding for a period of 10 days unless otherwise agreed. We are not obliged to accept any offers made.
3.3 After placement of your order we will send you a conformation that we received your order to the E-Mail adress stated by you. This order conformation confirms that we have received your order but is no acceptance of your order. A contract and a right to delivery arise only with the shipment conformation or delivery of your order.
4. Return policy
4.1 RIGHT OF WITHDRAWAL
You (the customer) have the right to cancel this contract within 14 days, without giving any reason.
The 14 day cancellation period starts from the day on which you or a third party named by you, that is not the carrier, has taken possession of the goods.
4.2 In order to exercise your right of withdrawal, you must contact

by means of a clear statement (e.g. a letter sent by post or e-mail) of your decision to withdraw from this contract. Also you have the choice to use the model withdrawal form.
4.3 To meet the cancellation deadline, it is sufficient to send your notification containing the statement of withdrawal before the cancellation period has expired.

4.4 CONSEQUENCES OF WITHDRAWAL
If you revoke this contract, we shall repay all the payments, which we received from you, including the delivery costs (with the exception of the additional costs that result from choosing a different type of delivery than the cheapest standard delivery offered by us have), immediately and at the latest within 14 days from the day on which we received the notification about the revocation of this contract from you.We will use the same means of payment that you used for the original transaction to make this repayment, unless something else was expressly agreed with you; there will be no case in that you are charged any fees for this repayment.
We can refuse the repayment until we have received the goods back or until evidence is provided that you have sent the goods back, whichever is earlier.
4.5 Please note that shipping costs are non refundable if you return your order from outside of the EU.
4.6 We are not carrying any custom charges for delivery and return from non EU countries. Should the case occure then We will deduct custom charges for return shipments from the refund total.
You must return or hand over the goods to us immediately and in any case no later than 14 days starting from the date on which you informed us of the cancellation of the contract. The deadline is met if you send to us the goods before the 14 day period has expired.

4.7 You carry all the direct costs related to returning the goods.
4.8 You must pay for any loss in value of the products if this loss in value is due to handling of the goods that is not necessary to check the nature, properties and functionality of the goods.
4.9 The right of withdrawal exists in principle, but does not apply to:
– Goods that have been sealed, for reasons of health protection or hygiene, and therefore are not suitable for a return after the seal has been removed
– Goods that have been manufactured according to customer specifications.
Customers are asked to treat products that they plan to return with care!
5. Shippment terms

5.1 The processing time of an order is usually between 1 – 4 business days with deviations possible.
5.2 We ship with Österreichische Post including insurance and tracking.
5.3 Delivery times for packages are:
– Austria: 2-3 working days
– Countries of the European Union: 2-10 working days
– Rest of the world: 5-25 working days

5.5 We do not charge any shipping costs to European countries.
For shipments to non-European countries we charge €40.
5.6 Note that for shipping to countries that are not part of the European Union, any import VAT and customs charges must be payed by you.
6. Prices and Payment
6.1 All prices are stated in Euros and value added tax is not collected, as small businesses according to austrian law § 6 Abs. 1 Z 27 UStG.
6.2 Shipping costs could be added to the total of your order depending on where you want the goods to be shipped.
7. Retention of Title
7.1 We reserve the title to the products untill payment hase been received in full.
8. Warranty
8.1 The warranty peroid is two years starting from when you receive the product(s).
8.2 There will be no warranty given in the following cases: damage to products caused by accident, attemted repair, ordinary wear and tear, incorrect or negligent handling or cleaning as well as unusual impacts, not following care advice.
9. Liability
9.1 We are only liable for damage that is caused intentionally or by gross negligence.
9.2 Our liability is limited to the actual purchase price and will therfore never be more than 100% of the price of the Products you have ordered from Us.
9.3 We are not taking liability for damages caused by acts of slight negligence, exept in the case of personal injury. We also exclude any liability for economic and financial losses, loss of income, revenues, contracts, data, third-party damages, opportunity or anticipated savings, indirect damages and subsequent damages or loss of reputation.

10.2 If you wish to manage your consent about Our cookie policy please visit: cookie policy.
10.3 Both Privacy Policy and Cookie Policy are incorporated into and form part of these GTCs.
11. General terms and conditions
11.1 You are only allowed to transfer your right or obligations under Our GTCs if We agree to this in writing.
11.2 If a court or relevant authority decides that any of the sections in our GTCs in unlawful then the remaining sections will stay in full effect.
11.3 This contract is between you and us. No other person shall have any rights to enforce any of its terms.
11.4 Our GTCs are exclusively governed by austrian law under exclusion of the conflict of laws and the united nation convention on contracts for the international sales of goods.
11.5 The place of jurisdiction is the court of Vienna. You can also file a claim at your place of recidence, however if you are not domiciled inside the European Union, the place of jurisdiction shall be Vienna.
11.6 Even if We delay in enforcing these GTCs, We are able to still enforce our right later. In the case that We do not insist immediately that you do anything you are required to do under these terms or if We delay in taking steps against you in respect of your braking this contract , that will not mean that you do not have to do those things and will not prevent Us taking steps against you at a later date.
